Terms of Service

Effective October 3, 2026

These Terms of Service (the "Terms") are an agreement between you and Unfairly, Inc., a Delaware corporation ("Unfairly," "we"). They cover the Pitch Unfairly plugin for ChatGPT, Codex, and other agents (the "Plugin"), deck and brand-kit hosting at pitchunfairly.com, and this website (together, the "Service"). By using the Service, connecting the Plugin to an Unfairly account, or publishing a deck, you accept these Terms. If you accept them for an organization, you confirm you can bind it, and "you" includes that organization. You must be at least 18 to use the Service.

Our Privacy Policy explains how we handle information. If your organization has a separate written agreement with Unfairly, that agreement controls where it conflicts with these Terms.

1. The Service

1.1 The Plugin. The Plugin's source code is published under the MIT License at github.com/Unfairly-AI/pitch-unfairly. That license governs your use of the code itself. These Terms govern the hosted parts of the Service: your account, publishing, hosting, and brand kits.

1.2 Agents and their providers. The Plugin runs inside agents made by other companies, such as ChatGPT and Codex. Your use of those agents is governed by their providers' terms, and we're not responsible for them. Agents can make mistakes; review what they build before you publish or present it.

1.3 Accounts. Publishing requires an Unfairly account. Keep your sign-in secure. You're responsible for what happens under your account, including actions an agent takes after you connect it. You can revoke a connected agent at any time.

1.4 Changes. We may change, limit, or stop parts of the Service, including file-size, deck-count, and usage limits. We'll give reasonable notice of changes that materially reduce what you can do.

2. Your content

2.1 You own it. Your decks, brand kits, and the files in them ("Your Content") remain yours.

2.2 What you let us do. You give Unfairly a worldwide, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content, and to serve it and its PDF to anyone who opens its link, only as needed to run and secure the Service. This license ends when Your Content is deleted, except for copies kept briefly in backups or as the law requires.

2.3 Your responsibility. You're responsible for Your Content and confirm you have the rights to publish it, including any text, data, images, fonts, logos, and trademarks in it. Font files and brand assets often carry licenses that limit web hosting; only publish ones you're allowed to use. The Plugin can capture the look of any public website you point it at. Using another company's brand doesn't give you rights to it, and you must not present a deck in a way that suggests a company made or endorsed it when it didn't.

2.4 Unlisted links. Published decks are unlisted, not private. Anyone with the link can view and share the deck and download its PDF. Don't publish confidential information you aren't comfortable sharing that way.

Publishing is free. Decks published from free accounts show a small "Made with Unfairly" badge linking to unfairly.ai. Removing the badge requires a paid arrangement with Unfairly. If we introduce paid plans, prices and terms will be shown before you buy, and paid features will be governed by those terms along with these.

5. Reports and takedowns

We may review, unpublish, or remove any deck, brand kit, or account that we reasonably believe breaks these Terms or the law, or creates risk for viewers or for Unfairly, and we'll tell you when we can. To report a deck, use the support page. To send a copyright notice, email legal@unfairly.ai with the deck's link, the work you believe is infringed, your contact details, a statement of good-faith belief that the use isn't authorized, and a statement under penalty of perjury that your notice is accurate and that you're the owner or authorized to act for the owner. We remove infringing material when appropriate and close the accounts of repeat infringers.

6. Ending use

You can stop using the Service at any time and ask us to delete your account and content (see the Privacy Policy). We may suspend or close your account if you break these Terms, if required by law, or if we stop offering the Service; when we stop offering it, we'll give at least 30 days' notice where we reasonably can. Sections 2.3, 5, and 7 through 10 survive.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, UNFAIRLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DECKS WILL ALWAYS BE AVAILABLE AT THEIR LINKS, OR THAT ANYTHING AN AGENT PRODUCES WILL BE ACCURATE. KEEP YOUR OWN COPY OF ANYTHING YOU PUBLISH.

8. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, UNFAIRLY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. UNFAIRLY'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID UNFAIRLY FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AND 100 US DOLLARS. Some places don't allow these limits, so they may not fully apply to you.

9. Indemnity

You'll defend and indemnify Unfairly against third-party claims arising from Your Content or your breach of these Terms, and pay amounts finally awarded or agreed in settlement, provided we notify you promptly and let you control the defense.

10. General

10.1 Law and venue. These Terms are governed by Delaware law, without regard to conflict-of-laws rules. Disputes go to the state and federal courts in Delaware, unless the law where you live gives you the right to bring a claim locally.

10.2 Changes to these Terms. We may update these Terms by posting a new version with a new effective date. For material changes we'll give reasonable notice before they take effect. Continuing to use the Service after that means you accept the update.

10.3 Everything else. These Terms and the Privacy Policy are the whole agreement about the Service. If part of them is unenforceable, the rest still applies. Not enforcing a provision isn't a waiver. You may not assign these Terms without our consent; we may assign them in a merger, acquisition, or sale of assets.
